Membership of the Program is open to any interested natural person, adult and residing in UK, its use is strictly personal, and it is only possible to have one account per person. Companies and associations cannot participate in the Program. ERBORIAN reserves the right to exclude persons who do not comply with these General Conditions.

By becoming a member of the Program, you declare that you have read and fully accept these general conditions applicable to the program (the "General Conditions") and any modifications that may be made thereto. We invite you to regularly consult these General Conditions and all the additional rules to which they refer, as well as a summary of questions and answers (FAQ) available to fully understand the conditions of membership and operation of the Program which may evolve. These Terms and Conditions are independent of any terms and conditions relating to product purchases or other existing programs and/or agreements. By registering for the Program, you also agree to be bound by our Personal Data Protection Policy, and by our general conditions of use of the www.uk.erborian.com site. If you do not expressly accept these General Conditions, our Privacy Policy and the general conditions of use of the site www.uk.erborian.com, you will not be able to participate or benefit from the advantages of the Program.

Membership of the Program and its benefits are at the discretion of ERBORIAN, which may terminate the Program at any time or modify the conditions of registration, the rules of operation or the benefits offered, by publishing on it any element modified on the site www.uk.erborian.com. Your continued participation in the Program after such postings signifies your approval of the changes made.

Program Membership

To join the Program and benefit from all the advantages, you must have an ERBORIAN UK customer account (“the Account”). You may choose to register online at www.uk.erborian.com.

If you do not have an Account, you can create one by logging on to www.uk.erborian.com, clicking on " Sign in / Register " and following the registration procedure in the "I’m new", you will then automatically be part of the Erborian loyalty program. 

Registration is completely free and without obligation to purchase.

Only one Account can be associated with an email address. In the event of a dispute concerning the Account Holder, the Member of the Program will be deemed to be the holder of the e-mail address provided during registration. Therefore, the Authorized Account Holder is the natural person who has been assigned the applicable email address by the Internet access provider, or online service provider or other organization responsible for assigning the email addresses for the domain name associated with the submitted email address.

By doing so, you agree to provide correct, accurate, current, and complete information necessary to register for the Program and complete the profile form, including the information provided to display your Account on www.erborian.com, and to promptly update this data so that it remains accurate, current and complete. If you provide false, inaccurate, outdated or incomplete information, or if ERBORIAN has reason to suspect that your registration information is false, inaccurate, outdated or incomplete or that you are abusing your membership in the Program in any way, ERBORIAN has the right to suspend, terminate or refuse your current or future use of the Program. Each member is solely responsible for maintaining the accuracy and updating of the personal information necessary to access his Account, to correct it directly on www.uk.erborian.com.

Purpose and operation of the Program 

The Erborian Family Rewards is a means of rewarding and thanking customers' loyalty for the purchase of our products and treatments, as well as their participation in certain online actions. You can earn points and reach different levels of the Program by making qualifying purchases or performing different actions, thus beginning the journey. As you accumulate points and reach levels, you begin your journey and become eligible to receive benefits applicable to the level reached. These may change or be available for a limited time. Qualifying purchases and other ways to earn points and reach various Program thresholds are posted on www.erborian.com.

The Program is tiered, determined by the number of Points earned on Enrolled Customer purchases over a twelve-month period and through qualifying activities.

On the day of your membership in the Program, you acquire the qualified status of Lover (“Lover”), and benefit from the corresponding advantages. You do not need to accumulate points to maintain the Lover level.
On the day you start collecting points (the “Start Date”), you begin your Erborian story (“Erborian Story”).

The Erborian Story lasts a maximum of 12 months, during which:

- If you accumulate 0 to 99 points: you have Lover status;

- If you collect 100 to 299 points: you acquire the qualified status of Obsessive ("Obsessive").

  •  If you have accumulated more than 100 points in the twelve months following your Start Date, you retain your Obsessive status. You restart your Erborian Story at Obsessive status with a point balance restored to 100 points, with a new Start Date starting the day after the previous story ended
  • If you have accumulated less than 100 points in the twelve months following your Start Date, we will switch to Lover status to continue your story. You restart your Erborian Story at Lover status with a point balance restored to 0 points, with a new Start Date starting the day after the previous story ends

- If you accumulate 300 points or more: you acquire the qualified status of Expert (»).

  • If you have accumulated more than 300 points in the twelve months following your Start Date, you retain your Expert status. You restart your Erborian Story at Expert status with a point balance restored to 300 points, with a new Start Date starting the day after the previous story ended
  • If you have accumulated between 100 and 299 points in the twelve months following your Start Date, we will switch to Obsessive status to continue your story. You restart your Erborian Story at Obsessive status with a point balance restored to 100 points, with a new Start Date starting the day after the previous story ended
  • If you have accumulated less than 100 points in the twelve months following your Start Date, we will switch to Lover status to continue your story. You restart your Erborian Story at Lover status with a point balance restored to 0 points, with a new Start Date starting the day after the previous story ends

Members of the Program can earn points in several ways:
You will receive one point for each euro spent on purchases of ERBORIAN France products (including VAT) at their normal price, reduced on the online store www.uk.erborian.com. Eligible purchases include all ERBORIAN products purchased excluding delivery charges.

In addition to your purchases, you can also earn points for the following online activities:

-    10 points from the creation of your Customer Account;
-    10 points for subscribing to the ERBORIAN newsletter;
-    5 points from the first connection to your account via Instagram;
-    From 5 to 15 points maximum for sharing your opinion online (on www.uk.erborian.com), validated by Customer Service, on an ERBORIAN product actually used;
-    1 opinion allows the accumulation of 5 points, a second of five points and a third of five points;
-    From 5 to 15 points maximum for the association of a photo with a review (on www.uk.erborian.com), validated by Customer Service, on an ERBORIAN product actually used;
-    1 photo allows the accumulation of 5 points, a second of five points and a third of five points. Only one photo is counted per notice posted on the www.uk.erborian.com site;
-    From 5 to 15 points maximum for the association of a video with a review (on www.uk.erborian.com), validated by Customer Service, on an ERBORIAN product actually used;
-    1 video allows the accumulation of 5 points, a second of five points and a third of five points. Only one video is counted per notice posted on the site www.uk.erborian.com.

To earn points, please ensure that you are a member of the Program and have logged into your Account before performing the above actions. The number of points eventually awarded for each action is determined by ERBORIAN in its sole and reasonable discretion.

Only purchases made through your Account, online at www.uk.erborian.com are eligible for the Program.

 Points are credited:
-    For online purchases at www.uk.erborian.com: the day after your order is shipped from the warehouse;

Points are deducted:
-    If they were accredited following a technical error committed by ERBORIAN UK;
-    If obtained from fraudulent or other activities that violate these Terms and Conditions;
-    In case of return or cancellation of the entire purchase, or in case of partial return or cancellation, only the points corresponding to the part of the purchase not withheld will be deducted;
-    Upon termination of membership in the Program for any reason.

You can check your points balance:
-    Directly at your account on www.uk.erborian.com;
-    In the header of communication e-mails relating to the Program;
-    On the e-mail associated with the online order.

Program Benefits and Rewards

As a participant in the Program, you earn points which determine your benefits and the thresholds and benefits of those tiers. To take advantage of offers and rewards, you must have accumulated the minimum number of points determined by ERBORIAN UK for each benefit. Points can never be redeemed for cash. You must log in to your account to take advantage of your benefits. Eligible Program participants may receive email invitations when rewards are available if they have not opted out of receiving Program emails. Some offers can only be sent by email, so make sure you share an up-to-date email address.

Points and benefits

When you have reached the rewards redemption threshold, you can be notified by email. Rewards can only be used with the next purchase.

Benefits per level

The benefits depend on the level reached and you are therefore entitled to benefit from them as soon as you reach the corresponding threshold, regardless of the number of points obtained at that time.

By joining the Program, all members are automatically entitled to the following benefits:
-    A welcome offer for the first purchase on the site www.uk.erborian.com;
-    Dedicated promotional offers if they have provided an e-mail address and if they have expressly agreed to receive them by ticking the acceptance box;
-    From previews to sales and Black Friday if they have provided an e-mail address and if they have expressly agreed to receive them by checking the acceptance box;
-    Birthday gift if the date of birth is communicated, (only with communication by e-mail);

Other advantages will then be added to these, depending on the number of points acquired and the thresholds reached:

1. Lover level: from 0 to 99 points
-    A fabric mask of your choice offered and free delivery for any purchase valid one month after the date of the anniversary and not compatible with any other current offer;
-    Standard Free delivery offered with £29 purchase.
-    1 voucher of five euros (£5.00) to be used on the next purchase from £6 of purchase and the first 50 points earned on the site www.uk.erborian.com. Can be redeem one time only. 

2. Obsessive level: 100 to 299 points
-    A free travel size treatment with a maximum value of £16 and free delivery for any purchase valid one month after the date of the birthday and not compatible with any other current offer (only with communication by e-mail);
-    Standard free delivery offered from £19 of purchase;
-    1 voucher of ten euros (£10.00) to be used on the next purchase from £11 of purchase and every 100 points earned on the site www.uk.erborian.com.

3. Expert level: from 300 points
-    A free travel size treatment with a maximum value of £18.50 and free delivery for any purchase valid one month after the date of the birthday and not compatible with any other current offer (only with communication by e-mail );
-    Standard Free delivery for any purchase;
-    1 voucher of ten euros (£10.00) to be used on the next purchase from £11 of purchase and every 100 points earned on the site www.uk.erborian.com;
-    Privileged access to our contests to test our new products in preview. (Only with communication by e-mail).

Terms of Benefits

Program rewards, benefits and offers are available while supplies last and/or their expiration date if limited in time. Product replacements may be made by us at our sole discretion. If your online order is not completed for any reason, any offers or rewards will be removed from the shopping cart and will no longer be available. We cannot return offers or rewards if they arrive damaged, you received the wrong one, or are missing. In the event of a damaged offer or reward received, if you have received the wrong one or if one is missing, you can contact ERBORIAN UK customer service.

Welcome offer

Standard Free delivery for any first order and 10% off on the site www.uk.erborian.com (except on sales, kits and giftsets). From £40 two miniatures 5ml of your choice offered with your personal code received by email. Offer valid once per person while supplies last on the site www.uk.erborian.com. Not compatible with any other current offers. Non-contractual visual. The kit is subject to change depending on available stocks. Offer valid for 1 months from receipt of the email.

£10 discount voucher

The "ten pounds voucher (£10.00)" advantage applies to any purchase of ERBORIAN products for a minimum amount of eleven euros (£11.00), each time 100 points are accumulated following the excess Obsessive status threshold, online at www.uk.erborian.com, provided that no delivery method has been chosen, such as in-store pick-up. This voucher cannot be combined with other current offers.

Birthday present

Once you have registered your email in your account and agreed to receive emails from the Erborian Family Rewards, you are entitled to a birthday gift:
-    If your status is Lover, you can take advantage of the following offer: a fabric mask of your choice offered and free delivery for any purchase valid within 30 days of your birthday and not compatible with any other current offer.
-    If your status is Obsessive, you can take advantage of the following offer: A free travel size treatment with a maximum value of £16 and free delivery for any purchase valid within 30 days of your birthday and not compatible with any other current offer.
-    If your status is Expert, you can take advantage of the following offer: A free travel size treatment with a maximum value of £18.50 and free delivery for any purchase valid within 30 days of your birthday and not compatible with any other current offer.

These three offers will be communicated to you only by email and cannot be combined with other existing promotions. They are not transferable to other people and can only be used once per customer per year.

General provisions

Neither Program accounts nor rewards, benefits and/or points may be transferred, shared or combined. Only the Account associated with payment for the products can earn benefits and/or points. We reserve the right to verify the number of Accounts per household and to reject, merge or terminate additional accounts

Benefits and points earned under the Program have no cash value and are not transferable. You also have no ownership rights in the benefits of the Program. The balance and/or points credited to your account will be reduced or canceled, as applicable, if all or part of a purchase is returned or canceled and if the credit is obtained as a result of fraudulent or other activity. The balance and/or the points credited to your Account will be reduced or canceled even following a technical error by ERBORIAN. The sale, barter, assignment or transfer of any prize or benefit offered by the Program, other than us, is expressly prohibited.

Rewards cannot be exchanged or returned for points, for another product or service, or for a cash refund.

The products and services available under the Program and any samples we may provide to you are for your personal use only. You may not sell or resell any products, services or samples purchased or otherwise received by us. We reserve the right to cancel or reduce the quantity of any order to be filled and/or any product or service to be provided to you which, in our opinion and at our sole discretion, may result in a breach of our Terms and Conditions.
We are not responsible for any rewards, benefits and/or points lost or redeemed due to fraudulent activity by you or any third party.

If your membership is terminated for any reason, all points will be forfeited.

We reserve the right to modify:
-    the benefits of the Program;
-    how points are accumulated;
-    Program thresholds and levels;
-    how we measure and reward your qualifying purchases and/or other Program activity.

We reserve the right to limit the number of purchases or activities eligible for the Program and/or for a certain threshold, the number or type of rewards or benefits that you may receive or earn at a certain level, in a certain period or for the duration of the program and/or any combination of the two options.

If you are concerned that a purchase or other activity has not been properly recorded on your account, you should contact ERBORIAN UK Customer Service. In the email, you must include your first name, last name and email address associated with the program, the date of the program activity and the issues you encountered. This e-mail must be sent within a maximum period of fifteen (15) days from the date of purchase or non-registration of the activity by the Program. We are not responsible for late notifications regarding purchases or other program activities that are not credited to an account.

Program Communications

To receive communications relating to the Program, you must log in to your Account, then select the option " Personalized & VIP offers after logging in to "Newsletter"- “Manage your subscriptions". Examples of these communications are: welcome emails or other communications that help us ensure that your account is being monitored. If you unsubscribe from Program-related communications, you will no longer receive emails regarding Program status or Program benefits.

By registering for the Program, you will not be automatically registered to receive marketing communications. If you agree to receive marketing communications, you should follow the instructions provided in Program emails and verify on our website at www.erborian.com or in the newsletter manager.

If multiple family members share an email address and/or mailing address, those members may choose to receive information and offers associated with a single Account. You can stop receiving communications relating to the Program The Erborian Family Rewards by accessing your account, then accessing "Newsletter", tab "Manage your subscriptions" and expressly choosing not to receive communications from the Program by ticking the box that offers you the corresponding option.

Termination and Amendments

The Program and its benefits are offered at our sole discretion. At our discretion, we may cancel, modify, limit or terminate these Terms and Conditions, our FAQs and/or the Program or any aspect or feature of the Program at any time without notice, although such changes may affect the value of rewards and /or benefits already accrued or earned and/or the ability to redeem accrued rewards or benefits.

We reserve the right to exclude you from the Program or terminate your participation and verify your Account at any time in our sole discretion. Any alleged abuse of the Program, non-compliance with the Terms and Conditions, inactivity of your Account for more than 24 months, illegal activity, fraud, misrepresentation or any other behavior not in accordance with these Terms and Conditions and/or harmful to us or our interests , including, in particular, any illegal, fraudulent and unauthorized use of Program rewards, points, cards, credits, vouchers, coupons and/or certificates may result in termination of your membership and render you ineligible for further participation in the Program . If your membership is terminated, all rewards or benefits in your Account will automatically expire and your access to the program and features will be automatically disabled. If we suspect illegal activity, fraud, misrepresentation, abuse or violation of these Terms and Conditions, we also have the right to take appropriate legal action, in our sole discretion.

If you unsubscribe, you will lose all accumulated points, benefits and your level. We also inform you that you can also exercise the rights over your personal data at any time. Exclusion of warranty - Limitation of liability

ERBORIAN UK, its parent companies, subsidiaries, affiliates, partners or licensees shall in no event be liable in any way whatsoever (contractual, non-contractual, by way of guarantee, for willful misconduct, negligence, gross negligence or negligence)) for (a) business interruption; (b) access delays or interruptions to the Program; (c) non-delivery of data, loss, theft, mis delivery, corruption, destruction or any other modification; (d) loss or damage of any kind resulting from transactions or the presence of third party links on the site or the use of any benefit of the Program; (e) computer viruses, system failures or malfunctions that may occur while using the site, including hyperlinking to or from third-party websites; (f) any inaccuracies or omissions in the content of the Program; or (g) events beyond our control.

We make no representation or warranty that defects or errors will be corrected. Furthermore, neither ERBORIAN France nor its parent companies, subsidiaries, affiliated companies, partners or licensees shall be liable in any capacity whatsoever (contractual, non-contractual, in warranty, willful misconduct, negligence, gross negligence) for indirect, particular damages, punitive, incidental or consequential of any kind (including lost profits) related to the Program or your participation.

You acknowledge that you may not bring any action arising out of or related to your participation in the Program, use of any Benefit, or these Terms after one (1) year after the event that generated the complaint or action. If you are dissatisfied with the Program, cancellation of your Program membership is your sole remedy. We have no other obligation, commitment or liability to you. 

Indemnity

You agree to defend, indemnify, hold harmless our company and our parent companies, subsidiaries, partners, licensees, managers, directors, employees and agents, from any liability arising out of and/or relating to any loss, damage or cost, including legal fees resulting from third party claims, actions or demands resulting from participation in the Program in violation of any law, rule or regulation of these Terms.

Applicable law and disputes

This Program and these General Conditions are governed by UK law. Any dispute relating to this Program, these General Conditions, participation in the Program or the relationship between the parties must be submitted to the competent UK jurisdiction.
